1. Acceptance of Terms

By creating an account or using SaboNick (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.

2. Description of Service

SaboNick is an AI-powered educational platform that generates personalized study lessons based on materials you upload, tailored to your VARK learning style (Visual, Auditory, Read/Write, or Kinesthetic). The Service uses third-party AI models to produce lesson content, quizzes, narration, and interactive exercises.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account. You may not share your account with others or use another person's account without permission. You must be at least 13 years old to use the Service.

4. User-Uploaded Content & Copyright

When you upload files, documents, or any materials (“User Content”) to SaboNick, you represent and warrant that:

You own the User Content or have the legal right to use it (e.g., you purchased the textbook, it is your own notes, or it is in the public domain).
Your use of the User Content through the Service is for personal study purposes only and does not constitute redistribution or commercial exploitation of copyrighted material.
You will not upload content that infringes on the intellectual property rights of any third party or that you do not have authorization to use.

SaboNick does not store your uploaded files beyond the immediate processing needed to generate your lesson. Your uploaded content is transmitted to one or more of our AI providers — Anthropic (Claude) and Google (Gemini) — solely to generate your personalized lesson. Lesson narration audio is synthesised by Amazon Polly or ElevenLabs; only the lesson text (not your original uploaded files) is sent for audio generation. Under each provider's API Terms of Service, none of these providers use content submitted through the API to train or improve their models. Your content is not retained by any provider after the request completes, is not shared with other users, and is not accessible to SaboNick staff. You are solely responsible for ensuring your use of uploaded materials complies with applicable copyright law. SaboNick accepts no liability for copyright infringement arising from User Content you upload.

5. AI-Generated Content Disclaimer

Lessons, quizzes, summaries, and other content generated by SaboNick are produced by AI and are intended for educational assistance only. AI-generated content may contain errors, inaccuracies, or omissions. SaboNick does not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content. Do not rely solely on SaboNick content for academic assessments, professional decisions, or situations where accuracy is critical. Always verify important information with authoritative sources.

6. Acceptable Use Policy

You agree not to use the Service to:

Upload content that is illegal, harmful, threatening, or violates any third-party rights
Attempt to reverse-engineer, scrape, or extract the AI models or platform infrastructure
Circumvent any access controls or security measures
Use the Service for any commercial purpose without prior written consent from SaboNick
Impersonate any person or entity or misrepresent your affiliation
Upload materials containing malware, viruses, or malicious code

We reserve the right to suspend or terminate your account if you violate this policy.

7. Privacy & Data

Your account information is managed securely through Clerk, our authentication provider. Uploaded file contents are processed by our AI providers (Anthropic and Google) to generate your lesson. The extracted text and the generated lesson are retained on our servers for up to 30 days so you can resume a lesson without regenerating it, then are no longer used. The original uploaded file itself is never stored. Lesson narration audio is generated by Amazon Polly or ElevenLabs using the lesson text only — your original uploaded files are never sent to these services. Your learning style assessment results and lesson preferences are stored to provide you with a personalized experience. We do not sell your personal data to third parties.

8. Intellectual Property

The SaboNick platform, brand, design, and software are owned by SaboNick and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from the platform without express written permission.

AI-generated lesson content produced from your uploaded materials is provided to you for your personal study use. You may not resell or redistribute AI-generated lessons.

9. Limitation of Liability

To the fullest extent permitted by law, SaboNick and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, academic consequences resulting from reliance on AI-generated content, or damages arising from unauthorized access to your account.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied.

10. Termination

You may delete your account at any time. We reserve the right to suspend or terminate access to the Service at our discretion, with or without notice, for violations of these Terms or for any other reason.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation before resorting to formal legal proceedings.
